Peripheral Manufacturing, Inc. warrants to the original purchaser that all magnetic media products shall be free from manufacturing defects in materials and workmanship.
 
For life, from date of purchase, Peripheral Manufacturing, Inc. warrants all products purchased from Peripheral Manufacturing, Inc. to be free from defects in materials and workmanship, new and remanufactured. Peripheral Manufacturing, Inc.'s sole obligation is limited to repairing or replacing, at no charge, all products that have been promptly reported by the purchaser as having been, in his or her opinion, defective and are so found by Peripheral Manufacturing, Inc. upon inspection. Proof of date sold must be returned with the defective product.
 
The above warranty shall remain in effect only if the Products are maintained in accordance with the applicable industry standards and practices. Peripheral Manufacturing, Inc.'s sole obligation under this warranty shall be the repair or replacement of the defective unit at Peripheral Manufacturing, Inc.'s option at no charge to the customer. The provisions of the above warranties do not apply to normal wear and tear, misuse, application or damage due to external causes or contamination.
 
The foregoing warranty is in lieu of all other warranties, either expressed or implied, including without limitation, any warranties or merchantability or fitness for a particular purpose, and all such warranties are hereby disclaimed and excluded by Peripheral Manufacturing, Inc.
 
Limitation of Remedies:
 
The sole and exclusive remedy for breach on any and all warranties and the sole remedy for Peripheral Manufacturing, Inc.'s liability of whatever nature or kind, including liability for negligence, with respect to the product(s) purchased or any performance by Peripheral Manufacturing, Inc. including delay for delivery or repair or replacement in accordance with the limited warranty article hereof. In no event shall Peripheral Manufacturing Inc.'s liability of any kind include special, incidental, or consequential damages, even if Peripheral Manufacturing, Inc. shall have been advised of the possibility of such potential loss or damage.
